These Terms & Conditions govern the purchase and use of digital products sold by Jorge Andere Gonzalez Calderon (Made by Jorchi), Friedrich-Hebbel-Straße 29, 81369 München, Germany, Email: madebyjorchi@gmail.com (“Seller”) through kbeautyplanner.com and associated sales platforms (Lemon Squeezy, Gumroad).

1. Products and Delivery

All products sold are digital downloads (PDF format). Upon successful payment, the buyer receives an email with an immediate download link. No physical product is shipped.

The Seller is not responsible for delivery failures caused by incorrect email addresses provided by the buyer.

2. Prices and Payment

All prices are displayed in EUR. Applicable taxes (including EU VAT where required) are calculated and collected at checkout by our payment processors. The Seller operates under the German Kleinunternehmerregelung (§ 19 UStG) and does not charge German VAT.

Accepted payment methods: credit/debit card via Stripe, PayPal, and other methods offered through Lemon Squeezy or Gumroad at checkout.

3. Right of Withdrawal — Digital Content Exception (EU Consumers)

Under EU consumer law (Directive 2011/83/EU), consumers normally have a 14-day right of withdrawal. However, this right does not apply to digital content that is not supplied on a tangible medium, where:

• Performance has begun with the consumer’s prior express consent, AND
• The consumer has acknowledged that they thereby lose their right of withdrawal

By completing a purchase on this website, the buyer expressly consents to immediate delivery of the digital content and acknowledges that they waive their 14-day right of withdrawal upon accessing the download link.

This waiver is confirmed via the mandatory checkbox at checkout. No refunds are offered once the digital file has been delivered.

4. No Refund Policy

Due to the nature of digital products, all sales are final. We do not offer refunds, exchanges, or cancellations after the download link has been accessed or after 48 hours from purchase, whichever comes first.

Exceptions may be considered at the Seller’s sole discretion in cases of technical failure preventing download. Contact us at madebyjorchi@gmail.com within 48 hours of purchase.

5. Medical and Health Disclaimer

All digital products sold on this website, including the Skin Barrier S.O.S. 28-Day Reset Plan, are provided for educational and informational purposes only.

They do not constitute medical advice, diagnosis, or treatment. The content is not a substitute for professional medical consultation, examination, or care by a licensed healthcare provider, including dermatologists or physicians.

Individual skin conditions, sensitivities, and medical histories vary widely and cannot be accounted for in these materials. The Seller expressly disclaims all liability for any adverse reactions, skin conditions, or health outcomes resulting from use of information in these products.

6. Intellectual Property

All content within the digital products (text, design, graphics, frameworks, and systems) is the intellectual property of Jorge Andere Gonzalez Calderon / Made by Jorchi and is protected under applicable copyright law.

Purchase grants the buyer a personal, non-exclusive, non-transferable license to use the content for personal use only. The buyer may not reproduce, redistribute, resell, share, or create derivative works from the purchased content without prior written permission.

7. Limitation of Liability

To the fullest extent permitted by applicable law, the Seller’s total liability for any claim arising from the purchase or use of digital products shall not exceed the amount paid for the specific product giving rise to the claim.

The Seller is not liable for indirect, incidental, special, or consequential damages including but not limited to loss of data, loss of revenue, or skin reactions.

8. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. For consumers within the EU, mandatory consumer protection provisions of the consumer’s country of residence also apply.

Place of jurisdiction for disputes with merchants (B2B) is Munich, Germany.

9. Dispute Resolution

The European Commission provides an online dispute resolution platform at: https://ec.europa.eu/consumers/odr

We are not obligated to participate in consumer arbitration proceedings and do not voluntarily do so.

10. Changes to These Terms

We reserve the right to update these Terms at any time. The version in force at the time of purchase applies to that transaction.

§ 1 Produkte und Lieferung

Alle angebotenen Produkte sind digitale Downloads (PDF-Format). Nach erfolgreichem Zahlungseingang erhält der Käufer einen sofortigen Download-Link per E-Mail. Es erfolgt keine physische Lieferung.

§ 2 Preise und Zahlung

Alle Preise werden in EUR angegeben. Der Verkäufer ist Kleinunternehmer gemäß § 19 UStG und weist keine Umsatzsteuer aus. Etwaige Steuern für EU-Verbraucher werden durch die jeweiligen Zahlungsdienstleister berechnet.

§ 3 Widerrufsrecht — Ausschluss bei digitalen Inhalten

EU-Verbrauchern steht grundsätzlich ein 14-tägiges Widerrufsrecht zu. Dieses erlischt bei digitalen Inhalten, die nicht auf einem körperlichen Datenträger geliefert werden, wenn:

• die Ausführung mit ausdrücklicher vorheriger Zustimmung des Verbrauchers begonnen hat, UND
• der Verbraucher bestätigt hat, dass er dadurch sein Widerrufsrecht verliert.

Mit Abschluss des Kaufvorgangs stimmt der Käufer der sofortigen Lieferung der digitalen Inhalte ausdrücklich zu und bestätigt, dass er sein Widerrufsrecht mit Zugang des Download-Links verliert. Die Bestätigung erfolgt über die Pflicht-Checkbox im Checkout-Prozess.

§ 4 Kein Rückgaberecht

Aufgrund der Natur digitaler Produkte sind alle Verkäufe endgültig. Rückerstattungen, Umtausch oder Stornierungen werden nach Zugang des Download-Links oder nach Ablauf von 48 Stunden ab Kauf nicht gewährt.

§ 5 Medizinischer Haftungsausschluss

Alle digitalen Produkte dienen ausschließlich zu Bildungs- und Informationszwecken. Sie stellen keine medizinische Beratung, Diagnose oder Behandlung dar und ersetzen nicht die Konsultation eines Arztes oder Dermatologen. Der Verkäufer übernimmt keine Haftung für Hautreaktionen oder gesundheitliche Schäden, die aus der Nutzung der bereitgestellten Informationen entstehen.

§ 6 Urheberrecht und Nutzungslizenz

Alle Inhalte der digitalen Produkte sind urheberrechtlich geschützt und Eigentum von Jorge Andere Gonzalez Calderon / Made by Jorchi. Der Käufer erhält eine persönliche, nicht übertragbare Lizenz zur privaten Nutzung. Eine Weitergabe, Vervielfältigung oder kommerzielle Verwertung ist ohne ausdrückliche schriftliche Genehmigung untersagt.

§ 7 Haftungsbeschränkung

Die Haftung des Verkäufers ist auf den für das jeweilige Produkt gezahlten Kaufpreis beschränkt, soweit gesetzlich zulässig. Eine Haftung für mittelbare Schäden, entgangenen Gewinn oder Schäden durch Hautreaktionen ist ausgeschlossen.

§ 8 Anwendbares Recht und Gerichtsstand

Es gilt deutsches Recht. Für Verbraucher innerhalb der EU gelten zusätzlich die zwingenden Verbraucherschutzvorschriften des jeweiligen Wohnsitzlandes. Gerichtsstand für Streitigkeiten mit Kaufleuten ist München.
